Welcome to LexEcho! These Terms of Service ("Terms") govern your use of the LexEcho application ("App") provided by SensesHub Corporation ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using LexEcho, you represent that:

You are at least 18 years old or have parental/guardian consent
You have the authority to accept these Terms
You will use the App in compliance with all applicable laws

2. Description of Service

LexEcho is an offline-first Augmentative and Alternative Communication (AAC) application designed as an educational and communication support tool for families and caregivers. The App provides:

Customizable communication boards with scene-based vocabulary
Text-to-speech functionality for verbal output
Communication logging for personal educational records
Educational Play & Learn module
Optional AI-powered photo-to-tile creation (requires internet connection)
Motivation features including streak tracking and celebrations

3. Medical and Health Disclaimer

Not a Medical or Health Service

LexEchoAAC is NOT a medical device, health application, or therapeutic service. It does not provide medical advice, diagnosis, treatment, or clinical intervention of any kind. LexEchoAAC is intended solely as a communication and educational support tool for families and caregivers.

3.1 Professional Services Exclusion

LexEchoAAC does not replace professional services, including but not limited to:

Speech-language pathology
Occupational therapy
Behavioral therapy
Psychological services
Medical care

3.2 No Guaranteed Outcomes

LexEchoAAC does not guarantee any specific communication, developmental, behavioral, or learning outcomes. Results may vary significantly depending on individual circumstances, consistency of use, and caregiver involvement.

3.3 Educational Purpose Only

All content, features, prompts, routines, and visual tools provided within LexEchoAAC are for educational and informational purposes only and should not be interpreted as professional advice of any kind.

3.4 No Emergency Use

CRITICAL: LexEchoAAC is not intended for emergency situations. Do not rely on LexEchoAAC for urgent, medical, behavioral, or safety-related decisions. In emergencies, contact local emergency services or a qualified professional.

4. Caregiver Responsibility and Supervision

LexEchoAAC is designed for use by caregivers and families. Caregivers are solely responsible for:

Supervising use of the application
Determining appropriateness for their child
Making decisions regarding communication supports
Reviewing any AI-generated content before presenting it to children

5. Parental Consent

LexEchoAAC is intended for use by caregivers on behalf of children. By creating an account, you confirm that you are a parent or legal guardian and consent to the child's supervised use of the application.

6. AI-Generated Content Disclaimer

Some features of LexEchoAAC may use automated or AI-assisted processes, including:

Photo-to-Tile creation using image recognition
IEP Builder suggestions and recommendations
Vocabulary suggestions

Such content is provided for general support and inspiration only and may not always be accurate, complete, or appropriate for every user. Caregivers should review and use discretion when applying any suggestions.

7. No Reliance

Users acknowledge that decisions regarding their child's communication, development, or care are made independently and not in reliance on LexEchoAAC.

8. License and Use Restrictions

8.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use LexEcho for personal, non-commercial purposes.

8.2 Restrictions

You agree NOT to:

Modify, reverse engineer, or decompile the App
Remove copyright or proprietary notices
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to our systems
Resell, redistribute, or sublicense the App
Use the App as a substitute for professional medical or therapeutic services

9. User Content and Data

9.1 Your Data

You retain ownership of all content you create or upload to the App, including:

Child profile information
Custom communication tiles
Photos uploaded for tile creation
Communication logs and reports

9.2 License to Your Content

By using the App, you grant us a limited license to:

Store and process your content to provide the service
Sync your data across sessions (when online)
Transmit photos to OpenAI Vision API when you use the Photo-to-Tile feature

9.3 Data Responsibility

You are responsible for backing up your data
We recommend periodically exporting reports as backups
While we strive for data security, no system is 100% secure

10. Parent Mode and Access Control

Parent mode is protected by a custom PIN set during onboarding
You are responsible for protecting your PIN and not sharing it with children
Administrative features are only accessible via parent mode
We are not responsible for unauthorized access due to shared or weak PINs

11. Third-Party Services

11.1 OpenAI Vision API

The Photo-to-Tile feature uses OpenAI's Vision API. By using this feature:

You agree to OpenAI's Terms of Use and Privacy Policy
Images are processed by OpenAI and subject to their data practices
This feature is optional - you can create custom tiles manually

11.2 Stripe Payment Processing

Payment processing is handled by Stripe. By subscribing:

You agree to Stripe's Terms of Service and Privacy Policy
We do not store your credit card information

11.3 Cloud Storage

When online, data may be synced to cloud servers. The App works fully offline if you prefer not to use cloud sync.

12. Subscription and Payment

LexEcho operates on a subscription model. Please refer to our Refund Policy for details on:

Subscription pricing and plans
Automatic renewal and billing
Cancellation and refund procedures

13. Intellectual Property

All content, features, and functionality of LexEcho are owned by SensesHub Corporation and protected by copyright, trademark, and other intellectual property laws.

14. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose
Non-infringement or error-free operation
Uninterrupted or secure access

We do not guarantee that the App will meet your requirements or be available at all times.

15. Limitation of Liability

To the maximum extent permitted by law, SensesHub Corporation and LexEchoAAC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to use of the application, including but not limited to:

Loss of data
Emotional distress
Perceived lack of outcomes
Loss of profits or business opportunities
Damages arising from use or inability to use the App

16. Indemnification

You agree to indemnify, defend, and hold harmless SensesHub Corporation, its officers, employees, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from:

Misuse of the application
Violation of these Terms
Your use of the App
Violation of any third-party rights

17. Updates and Modifications

We may update the App from time to time for bug fixes, features, or security
Updates may be automatic (mobile apps) or require manual action
We reserve the right to modify or discontinue features with notice

18. Termination

We reserve the right to suspend or terminate your access if you violate these Terms. You may stop using the App at any time by uninstalling it and canceling your subscription.

19. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.

20. Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the App with an updated "Effective Date." Continued use after changes constitutes acceptance.
